Jose B. Rodriguez, AIA, is the founding and managing Partner of D+K’s Ft. Lauderdale office. He is an “AV” Rated Attorney by Martindale Hubbell who concentrates his practice on defending architects, engineers, attorneys and surveyors throughout the State of Florida. He is recognized for his experience and working knowledge of design and the construction industry.

As a licensed Architect (Texas Reg. No. 18095), Mr. Rodriguez routinely counsels architects and engineers on effective risk management strategies for major projects. He is also frequently retained by nationally recognized organizations and represents numerous insurance companies to address professional liability claims asserted against its insured.

Representative cases handled by Mr. Rodriguez include:

+ In 2007, assigned to represent a Lloyd’s of London insured, a State of Florida licensed engineer. As a result of his action, he successfully argued Florida law prohibits a class action as a result of alleged construction defects in the construction of a typical “Model” home in a subdivision.

+ In 2006, defended a regional architect against various alleged construction defect claims and delays resulting from the construction of a high-rise assisted living facility. The composite claim by Owner and Contractor against the insured exceeded $5 million dollars. As a result of his legal intervention, the claim was ultimately settled for less than 10% of the aggregate claim. The insured was also successful in recovering over $75,000.00 for outstanding professional services fees.

+ In 2004, Mr. Rodriguez was retained and negotiated a $62 million dollar professional service fee agreement for an architect to design a resort island in the South Pacific.

Mr. Rodriguez actively lectures on professional liability issues that relate to design professionals and contractors, including issues associated with ownership transitional changes of design firms. He is also an adjunct professor of Building Construction Law.

+ 2010 AIA Tampa Chapter - Mr. Rodriguez, a featured speaker at the AIA Tampa Principal's Roundtable. Topics and presentation addressed architectural concerns regarding Caps on Liability/Creative Legal Theories and How to Avoid Them.
+ 2009 AIA Florida Convention - Mr. Rodriguez was guess speaker at the 2009 AIA Florida Chapter of the American Institute of Architects. Mr. Rodriguez addressed the Typical Claims Against Florida Architects in a lecture titled Managing Risk in a Down Economy.
+ 2008    Mr. Rodriguez was a guest panelist in a round table discussion, hosted by The Associated General Contractor Association of Florida. Mr. Rodriguez presented the AIA National’s position on the contrast between the AGC’s ConsensusDOCUMENTS and the AIA 2007 Form Agreements.
+ 2007    Mr. Rodriguez presented a lecture on Ownership Transitions- Professional Liability Issues Associated with Sales, Mergers, Acquisitions, Retirement and Other Ownership Changes Within Architectural Design Firms to the Tampa Bay Chapter of the Society for Design Administration, an Affiliate of The American Institute of Architects
